Что такое случай неисполнения обязательств?

Событие неисполнения обязательств – это предопределенное обстоятельство, которое позволяет кредитору потребовать полного погашения непогашенного остатка до наступления срока его погашения. Во многие соглашения кредитор будет включать положение контракта, охватывающее случаи неисполнения обязательств, чтобы защитить себя в случае, если окажется, что заемщик не сможет или не намерен продолжать погашение кредита в будущем. Случай неисполнения обязательств позволяет кредитору изъять любое обеспечение, которое было передано в залог, и продать его, чтобы возместить ссуду. Это часто используется, если риск невыполнения обязательств превышает определенный предел.

Однозначные условия являются обычными в правильно составленном кредитном соглашении, но соглашение для Sears является особенно подробным и ограничительным, поскольку кредитный синдикат принимает дополнительные меры предосторожности для защиты своих интересов.

Случай неисполнения обязательств по свопам на дефолт по кредиту

Своп кредитного дефолта ( CDS ) – это транзакция, в которой одна сторона, «защитный покупатель», платит другой стороне, «защитному продавцу», серию платежей в течение срока действия соглашения. По сути, покупатель оформляет страховку от вероятности того, что должник испытает событие неисполнения обязательств, которое поставит под угрозу его способность выполнять свои платежные обязательства.

Три наиболее распространенных таких события по определению Международной ассоциации свопов и деривативов (ISDA) : 1) подача заявления о банкротстве, 2) невыполнение платежа и 3) реструктуризация долга. Менее распространенными кредитными событиями являются неисполнение обязательств, ускорение исполнения обязательств и отказ / мораторий.
